HIA and RE Botanicals Sue DEA Over Hemp Rule
The Hemp Industries Association (HIA) and RE Botanicals, which also owns the Palmetto Harmony brand of hemp products founded by hemp pioneer Janel Ralph, filed a legal action against the Drug Enforcement Administration (DEA) on Friday regarding the Interim Final Rule (IFR) it issued on August 21, 2020. Legal action is necessary to protect the lawful US hemp industry that Congress intended to establish when it enacted the 2018 farm bill.

Why is the DEA even involved? I thought with the passage of the 2018 Farm Bill, hemp (cannabis with less than 0.3% delta9 THC) is no longer a controlled substance; seems like the DEA is over-stepping their boundaries. It’s a shame this issue, as well as the legality of “smokable hemp”, will ultimately have to be decided by the courts.
