Alabama’s New Hemp Retailer License: What You Need to Know 

Big changes are coming for Alabama’s hemp retailers. Starting January 1, 2026, only businesses with a Consumable Hemp Product (CHP) Retailer License from the Alabama Alcoholic Beverage Control Board (ABC) will be allowed to sell CHPs in the state. If you’re a retailer, pharmacy, or specialty shop, here’s what you need to know to stay compliant and keep your doors open.

Why the Change?

Alabama’s legislature passed HB445, a sweeping law designed to regulate the sale of CHPs. The goal? Protect public health, especially minors, and ensure all products meet strict safety and labeling standards. The ABC Board is now the official licensing authority for CHP retailers and has released pre-applications online.

Who Needs a License?

Only three types of retailers can sell CHPs starting 1/1/26:

  • Retail Food Stores
  • Pharmacies
  • Specialty Retailers

According to ABC representatives, if you’re currently selling CHPs and don’t have an ABC license by January 1, 2026, you’ll have to stop all sales until you’re licensed. Remember CHPs include beverages (up to 10mgs of total THC per 12 oz) and edibles (10mgs of total THC per serving/40mgs per carton), but do not include chemically modified, synthesized, or converted hemp products nor does it include smokable hemp products. Such products are prohibited.

How to Apply?

Pre-applications are now open online. The ABC Board has made forms and checklists available to help you prepare. Here’s what you’ll need:

  • Background Checks & Proof of Citizenship
  • Property Control Documents (lease, deed, or use agreement)
  • Tax Documentation
  • Surety Bond ($25,000)
  • Letter of Approval from your local governing authority
  • Sketch of the Proposed Licensed Premises

Once your pre-application is complete, submit it to your local ABC office. Officials will review your materials and walk you through the next steps toward full approval.

ABC is also in the process of developing and implementing a Label Review process for applicants and licensees as well.
